In four judgments delivered today and subject to wide publication, the Mixed Chamber of the Court of Cassation specifies the regime of claims for warranty against hidden defects:
- The action must be initiated within 2 years of the discovery of the defect and this is a limitation period and not a foreclosure period. The time limit is therefore suspended during the course of the judicial expertise;
- And this action must in any case be initiated no later than 20 years after the sale of the property.
